Accident at work : Wed Mar 30, 2016 6:34 am  
Can anyone help .

I'm self employed but sub contracted to a company. Last Wednesday on a building site I had a accident. Some guy accidently hit my little finger with metal bar.

I was off work Thursday, good friday, Saturday, Sunday, easter Monday and the Tuesday.

I rang them today to tell them I'll be back in on Wednesday as I feel fit to work but they told me I can't return until they have investigation and said we will have meeting on Thursday so I'll miss Thursday as well. As self employed I'm losing pay everyday.

Why can't I return to work? I'm fit to return. Why is the guy who did this still in work (he works for another company).

Just feels like I'm the one who's done wrong yet I was the one injured! I didn't want to push it or make big deal of it but this is a joke.



Is this standard procedure ?

An in-house investigation following an accident is standard operating procedure in most companies these days. As is putting a block on further work until such is carried out.

But the company can and will hurry through this phase should necessity dictate. Most likely they are trying to save themselves a few pounds paying a wage on a short week.

Just seems strange as I'm not going to put claim in as it was accident. The guy who injured me works for the site I was on and he's working and I'm losing pay

It's very common to see two people performing the same task (one employed by the company, the other a contractor) treated differently. It's the reason contractors exist in the first place.

The rules of the game are loaded against contractors. Which is why you should always have a good solicitor and accountant on the books.

I have good accountant and also in unite union. I kmow union is waste of time but they provide solicitor

They do for now, but once the fukctards in "government" puts the Small Claims limit up to £5000 (slated for April 17) that will likely change as in small claims each side pays their own costs so either a lawyer takes a slice of your compo or you DIY.

Do people only claim when the injury is deliberately caused?

Not at all, you just need to show that the injury was caused through negligence, or breach of duty of care.

Unite ARE a watse of time, the fact there are so many different Unions tells you that they're all pretty poor. All London based, execs on massive salaries etc.
