IIRC when that final accident happened, Hamilton was in 3rd. There were immediate waved yellows which means no overtaking unless there is a subsequent green flag waved, then the safety car came out. So the only way he could have got past Hamilton was to overtake under waved yellows. Even if he subsequently gave the place back, it's still an offence.
Didn't Toyota hold their hands up to the illegal kit on their car?
