Entirely agree but you still wouldn't have got your stadium.

I know...

its all talk and natter about irrelevant minor details, who did what to who, when and why, the trusts, the agreement, the bermuda triangle, are all superseded as soon as you can get your head around the fact that YC were never gonna build a stadium regardless, no matter what.....not gonna build it....ever, right from day one.
Yes they are lying cheating pondlife, but that isn't going to get us a ground, its a side issue and more than a little distracting since there doesn't appear to be any point in pursuing them for it, you could....just for the hell of it, but the focus has to be a new ground, pulling their pants down will not count towards it.

So is it down to the council to find the money to build the stadium now?

Exactly. As much as i'd like to see Mackie burn in hell chasing them legally will cost not only a fortune but the most important thing of all, time. All efforts now have to be about finding a different solution to a massive ground-shaped problem.

SC does the Council intend not to allow YC or its directors not to be able to get planning permission in the WF district?

Your question has been answered by Slugger but to answer it again they cannot refuse to consider a planning application. However they can make things very difficult and if they were to refuse an application then YC would appeal the decision. Interestingly they would appeal to the Planning Inspectorate, the very body to whom they made the promise to build the stadium in return for a planning consent. Now that would be interesting.

Also the public can object to any planning application that is submitted and if the application is passed there may be grounds for a Judicial Review which they would not want as it could open a can of worms. That would be the route to take if we wanted to go legal but that would be the last resort but we would not rule it out.

Hi guys, hope you're all well.

Sandal cat, have you guys had the opportunity to speak to the RFL with regard to what they consider as progress?

Whilst I appreciate that, in the grand scheme, YC walking away would be very refreshing, would the RFL consider the existing developer walking away from the scheme as progress?

Obviously I don't know how aware the RFL are of your plight, but on the face of it, YC walking away may be misconstrued as a backward step rather than progress.

That aside, I must congratulate you on going some way to dissuading other parties cooperating with SRW's "trust" over the existing one, who have the club and community at heart

It wouldn't be able to. In administrative law, which covers public bodies, there is something called "fettering discretion". Put simply, you can't pre-determine anything where you are supposed to apply discretion. They have to be seen to approach everything with an open mind and make the decision based upon what they hear.

They could do it de facto, however. It's how you record and announce your decision-making, and the reason behind it, that keeps you clean.

You seem to have such a deep knowledge of this subject Slugger that I think you may be Sir Rodney in disguise  :NAUGHTY:
